2024年商船（培训、发证和配员）（修订）规例及2024年防止海洋污染（压载水管理）（第二次修订）规例 MERCHANT     SHIPPING     (TRAINING,     CERTIFICATION     AND     MANNING) (AMENDMENT) REGULATIONS 2024 AND PREVENTION OF POLLUTION OF THE SEA (BALLAST WATER MANAGEMENT) (AMENDMENT NO. 2) REGULATIONS 2024

1. 本通函向航运界通报2024年11月1日生效的《商船（培训、发证和配员）规例》的修订情况，以及2017年《防止海洋污染（压载水管理）规例》将于2025年2月1日生效的修订情况。 This circular informs the shipping community on the amendments to the Merchant Shipping (Training, Certification and Manning) Regulations which entered into force on 01 November 2024, and the Prevention of Pollution of the Sea (Ballast Water Management) Regulations 2017 which will enter into force on 01 February 2025.

2. 国际海事组织（IMO）海事安全委员会（MSC）通过了MSC.540(107)号决议，对《海员培训、发证和值班标准国际公约》（STCW公约）进行了修订，该修订将于2025年1月1日生效（如2024年第8号航运通函先前所述）。 The Maritime Safety Committee (MSC) of the International Maritime Organization (IMO) had adopted amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW Convention), through Resolution MSC.540(107), which will enter into force on 01 January 2025 (as previously shared in Shipping Circular No. 8 of 2024).

MSC.540(107)号决议通过了对STCW公约的修订，以允许使用海员电子证书，这是顺应全球数字化趋势并作为管理和控制海员证书的一种解决方案。《商船（培训、发证和配员）规例》的修订使MSC.540(107)号决议生效。 Resolution MSC.540(107) adopted amendments to STCW Convention to allow the use of electronic certificates of seafarers, in response to the global digitalisation trend and as a solution to manage and control the seafarers’ certificates. The amendments to the Merchant Shipping (Training, Certification and Manning) Regulations give effect to the Resolution MSC.540(107).

2024年防止海洋污染（压载水管理）（第二次修订）规例 Prevention of Pollution of the Sea (Ballast Water Management) (Amendment No.  2) Regulations 2024

4. 国际海事组织海洋环境保护委员会（MEPC）还通过了MEPC.369(80)号决议，对《国际船舶压载水和沉积物控制与管理公约》（BWM公约）进行了修订，该修订将于2025年2月1日生效。 The Maritime Environment Protection Committee (MEPC) of the IMO had also adopted amendments to the International Convention for the Control and Management of Ships’ Ballast Water and Sediments (BWM Convention) through Resolution MEPC.369(80), which will enter into force on 01 February 2025.

5. MEPC.369(80)号决议通过了对BWM公约附录II的修订，对进行压载水作业的船舶需记录的信息提供了更明确的规定和要求。2017年《防止海洋污染（压载水管理）规例》的修订使MEPC.369(80)号决议生效。 Resolution MEPC.369(80) adopted amendments to Appendix II of the BWM Convention which provided greater clarity and requirements on information to be recorded by ships performing ballast water operations. The amendments to the Prevention of Pollution of the Sea (Ballast Water Management) Regulations 2017 give effect to the Resolution MEPC.369(80).
